What is Zoning?

Law:   Township Planning Act (Public Act 168 of 1959) MCL 125.321, et.seq
Established:By Township Board resolution
Status:

Public body subject to Open Meetings Act (OMA) and Freedom of Information Act (FOIA).

Members:   

Five (5) members appointed by the Supervisor with the approval of the Township Board.  Members must be qualified electors of the Township.  (Property ownership requirement ruled unconstitutional by Attorney General)  Members shall be representative of major interests as they exist in the township, such as agriculture, recreation, education, public health, government, commerce, transportation, and industry.

Quorum:Majority of membership.
Terms:

Three (3) years.  First terms after establishment of a Planning Commission are staggered 1-year, 2-years, 3-years.

Officers:

Chairperson, Vice-Chairperson, and Secretary.  Others as deemed appropriate.  All for 1-year terms.

Meetings:

First (1st) Thursday of each month, 7 pm.

Removal:  

Members may be removed by the Supervisor, after a hearing, with the approval of the Township Board.

Vacancy:

Successors must be appointed within one (1) month after term expires.  No deadline for other vacancies.

Financial:

Members may be compensated.  Planning Commission submits its' own budget to the Township Board for approval.  Expenditures and payments approved by Township Board, prepared by Township Clerk, and signed by Township Treasurer.

Authority:

Shall make and adopt a basic plan as a guide for the development of the unincorporated portions of the township.  Shall approve/deny construction, location, and character of streets, squares, parks, or other public ways, grounds or open space, or public buildings or structures.  Planning Commission shall include recommendations as to the zoning plan, districts, and ordinance, and per the Township's ordinance, approve special land uses, planned unit developments, and site plans.
